释义	法律分析：损害担责原则是指只要有污染环境和破坏生态的行为,即为损害,行为人就要承担责任。环境保护坚持保护优先、预防为主、综合治理、公众参与、损害担责的原则。企排放污染物的企业事业单位，应当按照国家有关规定缴纳排污费。法律依据：《中华人民共和国民法典》第一千二百二十九条因污染环境、破坏生态造成他人损害的，侵权人应当承担侵权责任。第一千二百三十二条侵权人违反法律规定故意污染环境、破坏生态造成严重后果的，被侵权人有权请求相应的惩罚性赔偿。
