释义	法律分析：如果非法集资案件到了法院，法院会组织清退，清退阶段会把剩余的全部钱款返还给集资人，余下的被集资组织者花费完的不予补偿，由集资人自行承担。法律依据：《最高人民法院关于刑事附带民事诉讼范围问题的规定》第五条犯罪分子非法占有、处置被害人财产而使其遭受物质损失的，人民法院应当依法予以追缴或者责令退赔。被追缴、退赔的情况，人民法院可以作为量刑情节予以考虑。经过追缴或者退赔仍不能弥补损失，被害人向人民法院民事审判庭另行提起民事诉讼的，人民法院可以受理。
