违规转包合法吗？

法律分析：
我国法律、法规均明确禁止转包并对转包的处理作出了明确的规定。
首先，转包行为无效。
其次，转包人因非法转包建设工程所获取的非法所得要予以没收。
再次，建设工程质量合格的，转承包人可以直接向发包人主张工程价款。
法律依据：
《中华人民共和国建筑法》 第二十八条 禁止承包单位将其承包的全部建筑工程转包给他人，禁止承包单位将其承包的全部建筑工程肢解以后以分包的名义分别转包给他人。
