释义	法律分析：一般情况下，判决生效后送往监狱应该是在一个月左右。判决之日起十日内是上诉期，十天后判决才生效，判决生效后，法院会在十天内开具相应的执行文书送达看守所，再由看守所移送监狱，但是看守所这边得等到一定人数之后才整批移送监狱，也会拖延一些时间。当然如果剩余刑期在三个月以下的，直接在看守所执行，不用移送监狱。法律依据：《中华人民共和国刑事诉讼法》第二百三十条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。
