释义	诉被告不出庭的，司法机关可以根据不同的情况作不同处理： 1.被告是必须到庭的，例离婚案件的被告，其不出庭，可拘传到庭。《中华人民共和国民事诉讼法》109条规定：“人民法院对必须到庭的被告，经两次传票传唤，无正当理由拒不到庭的，可以拘传。”只有对必须到庭的被告，才可以适用拘传。 2.并非必须到庭的被告，可作缺席判决处理，不影响案件的正常审理。《民事诉讼法》第144条规定，被告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以缺席判决。
