释义	第十七条登记人将登记在其名下的房屋擅自转让给他人，借名人以其对房屋享有实际权利为由，要求确认买卖合同无效的，不予支持，但借名人能够证明买受人知道或应当知道房屋存在借名登记的除外。买受人、借名人均要求继续履行合同的，可以参照本意见第十三条第一款的规定处理。
