释义	法律分析：批准逮捕，应当同时具备以下三个条件 1、有证据证明有犯罪事实 2、可能判处徒刑以上的刑罚 3、确有有逮捕必要。也就是说，不逮捕或者采取其他较缓和的强制措施，如取保候审和监视居住等方法，不足以防止发生社会危险性，因而有逮捕必要的。法律依据：《中华人民共和国刑事诉讼法》第八十条逮捕犯罪嫌疑人、被告人，必须经过人民检察院批准或者人民法院决定，由公安机关执行。
