释义	法律分析：被判处有期徒刑的罪犯，如果在罪犯交付执行前，有折抵刑期等情形的使剩余刑期三个月以上的，要在监狱服刑。一般情况下刑期在一年以下的，是在判决地当地看守所或者监狱服刑。法律依据：《中华人民共和国监狱法》第十五条人民法院对被判处死刑缓期二年执行、无期徒刑、有期徒刑的罪犯，应当将执行通知书、判决书送达羁押该罪犯的公安机关，公安机关应当自收到执行通知书、判决书之日起一个月内将该罪犯送交监狱执行刑罚。罪犯在被交付执行刑罚前，剩余刑期在三个月以下的，由看守所代为执行。
