释义	无罪推定一般指无罪推定原则。无罪推定，简单地说是指任何人在未经证实和判决有罪之前，应视其无罪。因此，无罪推定所强调的是对被告人所指控的罪行，必须有充分、确凿、有效的证据。如果审判中不能证明其有罪，就应推定其无罪。应该说这一原则对于保障被告人的诉讼权利、诉讼地位发挥了巨大的作用。法律依据：《中华人民共和国刑事诉讼法》第十二条未经人民法院依法判决，对任何人都不得确定有罪。
