释义	法律分析: 公司的攻击基金与资本公积金是不一样的，资本的公积金是不可以作为公司的亏损的弥补的，但是公司的公积金可以，资本公积金可以用于扩充公司的资金，扩大经营的规模，但是必须不少于公司资金的百分之二十，这是规定的。法律依据: 《中华人民共和国公司法》已失效第一百六十八条公司的公积金用于弥补公司的亏损、扩大公司生产经营或者转为增加公司资本。但是，资本公积金不得用于弥补公司的亏损。法定公积金转为资本时，所留存的该项公积金不得少于转增前公司注册资本的百分之二十五。
