释义	法律主观：刑事诉讼法期间计算的规定：《刑事诉讼法》第一百零五条期间以时、日、月计算。期间开始的时和日不算在期间以内。法定期间不包括路途上的时间。上诉状或者其他文件在期满前已经交邮的，不算过期。期间的最后一日为节假日的，以节假日后的第一日为期满日期，但犯罪嫌疑人、被告人或者罪犯在押期间，应当至期满之日为止，不得因节假日而延长。第七十六条指定居所监视居住的期限应当折抵刑期。被判处管制的，监视居住一日折抵刑期一日；被判处拘役、有期徒刑的，监视居住二日折抵刑期一日。
