释义	法律分析：根据我国法律规定，我国审判采取两审终审制，诉讼当事人对地方各级人民法院的一审判决，裁定不服的，在诉讼期间内，一审判决，裁定尚未生效前，依据法定程序向上级人民法院申请上诉二审。当地方各级人民法院的二审判决，裁定生效后，此为终审判决。此时二审判决为最终判决。但是若却有事实判断错误等内容，可以申诉再审或者人民法院审判监督予以纠正。法律依据：《中华人民共和国民事诉讼法》第一百七十五条第二审人民法院的判决、裁定，是终审的判决、裁定。
