释义	法律分析: 没有合法的根据而取得非法的利益的行为。如拾得遗失物据为己有等。法律要求将取得的非法利益返还给受害人。法律依据: 《中华人民共和国民法典》第一百二十二条因他人没有法律根据，取得不当利益，受损失的人有权请求其返还不当利益。第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：(一)为履行道德义务进行的给付;(二)债务到期之前的清偿;(三)明知无给付义务而进行的债务清偿。
