释义	法律分析：免予刑事处罚不能视为判处刑罚。免予刑事处罚就是认为犯罪嫌疑人有罪，因法定情况不处罚，免于刑事处罚，是有罪而免罚，仍然构成刑事犯罪，通俗地说就是有犯罪前科，而无罪判决的法律后果是，当嫌疑人被羁押的，应当立即释放，无罪，当然就无需承担刑事责任，不受刑事处罚。法律依据：《中华人民共和国刑法》第三十七条对于犯罪情节轻微不需要判处刑罚的，可以免予刑事处罚，但是可以根据案件的不同情况，予以训诫或者责令具结悔过、赔礼道歉、赔偿损失，或者由主管部门予以行政处罚或者行政处分。
