释义	法律分析：依据我国相关法律的规定，行政诉讼的原告死亡后，如果没有近亲属或者近亲属放弃诉讼权利的，行政诉讼案件就会终结。法律依据：《最高人民法院关于适用《中华人民共和国行政诉讼法》的解释》第八十八条在诉讼过程中，有下列情形之一的，终结诉讼： (一)原告死亡，没有近亲属或者近亲属放弃诉讼权利的; (二)作为原告的法人或者其他组织终止后，其权利义务的承受人放弃诉讼权利的。因本解释第八十七条第一款第一、二、三项原因中止诉讼满九十日仍无人继续诉讼的，裁定终结诉讼，但有特殊情况的除外。
