释义	故意刹车追尾是犯罪吗除非有证据证明前车故意别车，在前面紧急急刹，否则会判后车全责。法律规定《中华人民共和国道路交通安全法》第43条规定，同车道行驶的机动车，后车应当与前车保持足以采取紧急制动措施的安全距离。只要前车一方当事人没有违反规定在专用车道内行驶的；在道路上进行维修、养护等作业时，未按规定使用黄色标志灯、危险报警的违法行为，则后车一方当事人就要负全部责任。否则，双方当事人应当各负同等责任。
