释义	法律主观：合同违约金百分之二十的约定是否有效要根据合同内容分析，违约金比例没有统一的规定。《合同法》第114条第1款规定：当事人可以约定一方违约时应当根据违约情况向对方支付一定数额的违约金，也可以约定因违约产生的损失赔偿额的计算方法。所以，违约金具有惩罚性的特征，它不以非违约方遭受损失为前提。一般来说合同违约金上限是不超过标的的20%。但是如果过高或者过低是可以请求法院给予减少或者增加的。
