释义	法律分析：开发商不能在约定时间交付房屋的话，就会构成延期交房。开发商应当依照购房合同的约定承担违约责任。开发商延期交房的，经购房人催告后，要是在三个月的合理期限内还没有履行，购房人可请求解除合同的，购房人在法律规定期限内可以要求解除合同并要求开发商退还房价款、利息并赔偿损失。如存在不可抗力，开发商逾期交房不承担违约责任。法律依据：《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
