释义	法律分析：可以的，但不能超过1%，也不能是前十名股东。法律依据：《关于在上市公司建立独立董事制度的指导意见》第三条直接或间接持有上市公司已发行股份1%以上或者是上市公司前10名股东中的自然人股东及其直系亲属下列人员不得担任独立董事。也就是说，只要独立董事的持股比例不超过1%，或者尚未达到上市公司前10名股东的程度，就不构成公司的大股东，自然具有担任独立董事的资格。
