释义	法律分析：如果是刑事诉讼案件,则被告人可以以口头形式进行上诉,并不是必须提交上诉状,口头上诉是有效的。法律依据：《最高人民法院关于适用《中华人民共和国民事诉讼法》的解释》第三百二十条一审宣判时或者判决书、裁定书送达时，当事人口头表示上诉的，人民法院应告知其必须在法定上诉期间内递交上诉状。未在法定上诉期间内递交上诉状的，视为未提起上诉。虽递交上诉状，但未在指定的期限内交纳上诉费的，按自动撤回上诉处理。
