过失致人死亡罪有什么规定 |

《刑法》第二百三十三过失致人死亡的，处三年以上七年以下有期徒刑；情节较轻的，处三年以下有期徒刑。本法另有规定的，依照规定。

第八条第二款在公共交通管理的范围外，驾驶机动车辆或者使用其他交通工具致人伤亡或者致使公共财产或者他人财产遭受重大损失，构成犯罪的，分别依照刑法第一百三十四条、第一百三十五条、第二百三十三条等规定定罪处罚。
一、过失致人死亡罪怎么量刑
过失致人死亡罪，是指行为人因疏忽大意没有预见到或者已经预见到而轻信能够避免造成的他人死亡，剥夺他人生命权的行为。
构成过失致人死亡罪的，需具备三个要素：
1、客观上必须发生致他人死亡的实际后果。这是本罪成立的前提。
2、行为人必须实施过失致人死亡的行为。
行为人的行为可能是有意识的，或者说是故意的，但对致使他人死亡结果发生是没有预见的，是过失。过失致人死亡行为可以分为作为的过失致人亡行为和不作为的过失致人死亡行为两种情况。
3、从行为人的过失行为与被害人死亡的结果之间必须具有间接的因果关系，即被害人死亡是由于行为人的行为造成的。
这里死亡包括当场死亡和因伤势过重或者当时没有救活的条件经抢救而死亡。否则行为人不应承担过失致人死亡罪的刑事责任。
《刑法》第二百三十三条规定，过失致人死亡的，处三年以上七年以下有期徒刑；
情节较轻的，处三年以下有期徒刑。
既然是过失致人死亡罪，证明行为人在主观上并没有剥夺被害人生命的意图，往往是因为自身疏忽大意或者过于自信导致被害人的死亡。由于这属于典型的过失犯罪，根据《刑法》中量刑规定来看，对行为人的处罚最高也才7年有期徒刑。
