问题	发生著作权纠纷如何处置呢
释义	发生著作权纠纷，先行调解；双方达成书面仲裁协议或者著作权合同中有仲裁条款的，向仲裁机构申请仲裁；没有约定仲裁的，直接向人民法院起诉。中国公民、法人或者非法人组织的作品，不论是否发表，享有著作权。法律依据：《中华人民共和国著作权法》第六十条著作权纠纷可以调解，也可以根据当事人达成的书面仲裁协议或者著作权合同中的仲裁条款，向仲裁机构申请仲裁。当事人没有书面仲裁协议，也没有在著作权合同中订立仲裁条款的，可以直接向人民法院起诉。
