释义	法律分析：看情况：其一、合同有效：一、双方约定可以退款的，则可以退款；二、没有约定的，一方要求解除合同退款的行为是违约行为。双方协商一致，可以退款，但违约方需要承担违约责任。其二、合同无效或者可撤销：自合同确认无效或者被撤销之后，因该合同取得的财产不能返还或者没有必要返还的，可以退款，折价补偿。法律依据：《中华人民共和国民法典》第一百四十八条一方以欺诈手段，使对方在违背真实意思的情况下实施的民事法律行为，受欺诈方有权请求人民法院或者仲裁机构予以撤销。
