2023年认购书的首付可以退吗

法律分析：
不可以退。签订了认购协议书，交了首付款，就是合法有效的，是不能退房的。如果想要退房，必须与对方协商，取得对方的同意。即使对方同意退房，买房人也应当承担违约责任，赔偿卖房人的损失，所以，首付款是不能全部退还的。
法律依据：
《中华人民共和国民法典》 第四百六十五条 依法成立的合同，受法律保护。依法成立的合同，仅对当事人具有法律约束力，但是法律另有规定的除外。
