释义	法律分析：地上建筑物是随土地走的，如果土地使用权已抵押，后续建的建筑也一并抵押了，不能再进行再抵押或处置了，否则无效。我国实行的是房地一体流转制度，“房随地走，地随房走”，而且法律对这一流转方式的规定为强行规定，如果当事人只约定房、地中一部分抵押的，另一部分也会视为抵押。法律依据：《中华人民共和国民法典》第三百九十八条乡镇、村企业的建设用地使用权不得单独抵押。以乡镇、村企业的厂房等建筑物抵押的，其占用范围内的建设用地使用权一并抵押。
