释义	刑法对假冒专利罪的处罚标准的规定是，自然人犯该罪的，处三年以下有期徒刑或者拘役，并处或者单处罚金；单位犯该罪的，对单位处罚金，并对其直接负责的主管人员和其他直接责任人员，按照上述标准处罚。【法律依据】《中华人民共和国刑法》第二百一十六条假冒他人专利，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。第二百二十条单位犯本节第二百一十三条至第二百一十九条规定之罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照本节各该条的规定处罚。
