释义	如果当事人是没有自理能力的，在护工护理状态下摔伤则是护工照顾不周，应由护工负责赔偿。如果当事人有部分自理能力，当事人想做做不了的事，叫护理员处理而护理员没有及时处理，仍然是护工的责任。如果当事人有完全自理能力，在非护工过错的情况下，当事人自己摔伤的，则是当事人自己负责。法律依据：《中华人民共和国民法典》第五百七十七条 【违约责任】当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
