释义	法律分析：未经公司登记机关登记，不得以公司名义从事经营活动。并且在《管理条例》中，对于未依法登记为有限责任公司或有限责任公司分公司的，冒用其有限责任公司或有限责任公司分公司名义的行为，将由登记机关对其进行责令改正或予以取缔，最高将处于10万元以下的罚款。法律依据：《中华人民共和国公司登记管理条例》第三条公司经公司登记机关依法登记，领取《企业法人营业执照》，方取得企业法人资格。自本条例施行之日起设立公司，未经公司登记机关登记的，不得以公司名义从事经营活动。
