释义	教唆、帮助他人自杀应当以故意杀人罪论处，但考虑到在教唆、帮助自杀中，自杀者的行为往往起决定作用，因此，应根据案情从宽处罚。如果行为人的行为不很积极，作用不大，主观愿望出于善意，这时可不以犯罪论处。但是，教唆精神病人或未成年人自杀，由于自杀者限于精神状态或年龄因素对于自杀缺乏正确的认识和意志控制能力，对此，不仅要以故意杀人罪论处，而且还不能从轻或减轻处罚。【法律依据】《刑法》第二百三十二条，故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑;情节较轻的，处三年以上十年以下有期徒刑。
