释义	法律分析：目前国家规定是不允许有首付贷存在的，如果开发商还是有打着首付贷的名义给客户放款的话，肯定是不合法的。但是目前市面上用作首付的产品一般都是采用不上征信的贷款来充当，这种产品都是属于消费贷，因为不上征信，所以用作首付也不会被发现的。法律依据：《最高人民法院关于人民法院审理借贷案件的若干意见》第十条一方以欺诈、胁迫等手段或者乘人之危，使对方在违背真实意思的情况下所形成的借贷关系，应认定为无效。第十一条出借人明知借款人是为了进行非法活动而借款的，其借贷关系不予保护。
