婚内出轨第三者是不是犯法
释义
婚内出轨第三者只要不构成重婚就不违反，更不犯罪。出轨虽然会受到道德上的谴责，但这并不是一种违法行为。
如果出轨方以夫妻名义与第三者共同生活，或者与第三者结婚的，则会构成重婚，此时是违法的，如果重婚情节严重甚至会构成重婚罪。
【法律依据】
《刑法》第二百五十八条，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
