商品房的使用年限是从开发商缴纳土地出让金那天开始计算。就是说，等房子到了业主手里，产权至少已经过了一两年了
法律依据：
《中华人民共和国城镇国有土地使用权出让和转让暂行条例》 第十二条 土地使用权出让最高年限按下列用途确定：
(一)居住用地七十年(二)工业用地五十年(三)教育、科技、文化、卫生、体育用地五十年(四)商业、旅游、娱乐用地四十年(五)综合或者其他用地五十年。
