设立居住权的住宅可以进行出租么

设立居住权的住宅一般不可以进行出租。居住权是指按照合同约定对他人所有的住房及其附设施占有、使用的权利,具有人身专属性,居住权人不属于该房屋的所有权人,无权对房屋进行租赁收益的,居住合同中另有约定的除外。

《《中华人民共和国民法典》》第三百六十九条
【居住权的转让、继承和设立居住权的住宅出租】居住权不得转让、继承。设立居住权的住宅不得出租,但是当事人另有约定的除外。
