商用房子40年到期怎样办 |

40年产权的商住房四十年后可以申请续期，缴纳土地使用费用后继续使用。土地使用权出让合同约定的使用年限届满，土地使用者需要继续使用土地的，应当至迟于届满前一年申请续期，除根据社会公共利益需要收回该幅土地的，应当予以批准。40年产权的房子到期了有土地出让是有偿的，土地使用权到期后如需继续使用，需提出申请并缴纳土地出让金。根据国家现行的相关规定，土地到期后按照当时的楼面毛地指导价格，依一定比例缴费。四环中心线以内，按指导价40%补交。四环路中心线以外，按指导价60%补交。房屋产权不同是因为土地用途不同：居住用地70年，工业用地50年，教育、科技、文化、卫生、体育用地50年，商业、旅游、娱乐用地40年，综合或者其他用地50年。非住宅建设用地使用权期限届满后的续期，依照法律规定办理。该土地上的房屋以及其他不动产的归属，有约定的，按照约定；没有约定或者约定不明确的，依照法律、行政法规的规定办理。
法律依据：《民法典》第三百五十九条：住宅建设用地使用权期限届满的，自动续期。续期费用的缴纳或者减免，依照法律、行政法规的规定办理。非住宅建设用地使用权期限届满后的续期，依照法律规定办理。该土地上的房屋以及其他不动产的归属，有约定的，按照约定；没有约定或者约定不明确的，依照法律、行政法规的规定办理。
