释义	法律分析：可以。撤诉的时间必须是在法院受理案件之后，宣告判决之前。但是否准许撤诉要由法院来裁定，如果在法院宣判后再提起撤诉就不能申请了。申请撤诉的人必须是有申请撤诉权的人。申请撤诉在实体上不得有规避法律的行为，不得违反现行法律、法规的规定，不得有损于国家、集体和他人的利益。法律依据：《中华人民共和国民事诉讼法》第一百四十五条宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。
