释义	法律主观：找不到一方当事人，需要离婚的，一方可以先申请宣告失踪，然后到法院起诉离婚。也可以直接到法院起诉离婚，人民法院会先作出公告送达，公告期满后，视为送达，人民法院会直接作出判决。《民事诉讼法》第九十二条规定，受送达人下落不明，或者用本节规定的其他方式无法送达的，公告送达。自发出公告之日起，经过六十日，即视为送达。根据2021年1月1日实施的《民法典》第一千零七十九条第四款规定，一方被宣告失踪，另一方提起离婚诉讼的，应当准予离婚。
