释义	法律分析：保证金应当以书面形式约定。在实践中，如果双方在口头上约定了定金合同并履行了主要合同义务，则另一方所接受的定金合同有效。收到定金的一方违反合同约定或者双方同意解除合同的，可以退还定金。法律依据：《中华人民共和国民法典》第五百八十七条债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
