释义	【法律意见】可以要求赔偿。单位以你不能胜任工作为理由辞退，应该拿出不能胜任工作的证据，或者应该额外支付一个月工资，并且要按照劳动合同法第四十七条的规定给你经济补偿。你这样的情况直接到当地劳动部门投诉吧，可以要求劳动仲裁，去之前先给那边打电话问问需要你准备什么材料。【法律依据】根据劳动合同法，第八十二条用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。前款规定的用人单位向劳动者每月支付两倍工资的起算时间为用工之日起满一个月的次日。
