释义	法律分析： 1、客体要件，本罪侵犯的客体是公民的民主权利和国家机关的正常活动；2、客观要件，本罪在客观方面表现为对证人进行打击报复的行为；3、主体要件，本罪的主体为一般主体；4、主观要件，本罪在主观方面表现为故意。法律依据：《中华人民共和国刑法》第三百零八条对证人进行打击报复的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
