释义	1、遗弃行为的判定方式为对于年幼、老年、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的行为。 2、此时行为人构成遗弃罪，应当承担相应的刑事责任。法律依据《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
