释义	法律分析：用人单位与劳动者在自用工之日起一个月不到一年内没有订立书面劳动合同或者不与劳动者订立无固定期限劳动合同的，分别应当每月支付或者是自用工之日起支付二倍工资。在某些特殊的时间段进行加班的员工是可以享受到额外的福利的，例如双倍工资、三倍工资等等。法律依据：《中华人民共和国劳动合同法》第三条订立劳动合同，应当遵循合法、公平、平等自愿、协商一致、诚实信用的原则。依法订立的劳动合同具有约束力，用人单位与劳动者应当履行劳动合同约定的义务。
