释义	租房合同的押金能否退还应当根据合同的内容进行判断。具体而言存在以下3种情形：第一，房屋租赁合同双方有约定的，押金按照约定退还；第二，合同没有约定，承租人支付了押金，在合同的履行过程中租赁人存在违约行为的，押金不能退还；第三，租赁人支付了押金，在合同的履行过程中出租人存在违约行为，合同未就押金做出约定的，押金应当退还给承租人。【法律依据】《民法典》第七百零三条，租赁合同是出租人将租赁物交付承租人使用、收益，承租人支付租金的合同。
