释义	按照法律规定，一般情形下，再审案件应当在三个月内审结。如果属于重大、疑难、复杂的案件，可以延长期限，但不能超过六个月。需要注意的是，对于检察院抗诉案件，如果需要指令下级人民法院再审，接受抗诉的人民法院有为期一个月的决定期限。法律依据：《中华人民共和国民事诉讼法》第二百零五条当事人申请再审，应当在判决、裁定发生法律效力后六个月内提出；有本法第二百条第一项、第三项、第十二项、第十三项规定情形的，自知道或者应当知道之日起六个月内提出。
