单位签订劳动合同时应注意什么
释义
法律分析:(1)用人单位与劳动者订立劳动合同,应切实遵循平等自愿、协商一致的原则;(2)企业与劳动者订立劳动合同时,一定要查验终止或解除劳动合同的证明及其他能够证明劳动者与任何用人单位不存在劳动关系的凭证,方可与其签订劳动合同;(3)订立劳动合同时,劳动者一方不得由他人代替。
法律依据:《中华人民共和国劳动合同法》第三条 基本原则,订立劳动合同,应当遵循合法、公平、平等自愿、协商一致、诚实信用的原则。依法订立的劳动合同具有约束力,用人单位与劳动者应当履行劳动合同约定的义务。
