释义	法律分析：（一）在房屋租赁关系上，要求解除租赁合同的一方，也就是退房应该提取1个月通知对方，否则就属于违约（合同另有约定除外）；（二）租房合同中对违约金有约定（租房违约金的数额是由当事人双方通过事先约定而确定的），比如退房违约金则按约定的违约金比例支付；（三）约定的违约金过高或过低可以请求变更，约定的违约金超过实际损失30％的可认为约定过高，也就是退房违约金过高可要求降低；（四）房屋租赁合同中对违约金没有约定，也就是没有退房违约金约定的，应按对方违约对自己造成的实际损失来计算违约金并退回押金和多余的房费；（五）租房违约金的支付也就是退房违约金是独立于履行行为即给付房租之外的给付；（六）租房违约金的处理：双方按照租赁合法律依据：《中华人民共和国民法典》第五百八十四条当事人一方不履行合同义务或者履行合同义务不符合约定，造成对方损失的，损失赔偿额应当相当于因违约所造成的损失，包括合同履行后可以获得的利益；但是，不得超过违约方订立合同时预见到或者应当预见到的因违约可能造成的损失。
