释义	刑法面前人人平等原则，也是我国刑法明文规定的一项基本原则。该原则的含义是：任何人犯罪，不论犯罪的人的家庭出身、社会地位、职业性质、财产状况、政治面貌、才能业绩如何，都应平等的适用刑法追究刑事责任，不允许任何人有凌驾于法律之上的特权。刑法面前人人平等原则要求：在定罪时要平等，不能因犯罪人身份、财产等不同而有的定轻罪，有的定重罪；在量刑时要平等，不能因犯罪人的地位不同而有的判重刑，有的判轻刑；在刑罚执行时要平等，不能因犯罪人身份、地位的不同而给予不同的待遇。
