释义	相约自杀行为可以构成故意杀人罪吗相约自杀行为是不构成故意杀人罪的。相约自杀，是指两人以上相互约定自愿共同自杀的行为。目前在我国刑法司法实践中，普遍认为对于相约自杀的行为，在自杀的过程中，没有强制或诱骗的因素，不具备故意杀人罪的特征，因而不能认定为故意杀人罪，不应追究行为人的刑事责任。相约自杀，无故意剥夺他人生命的主观意图，亦无故意剥夺他人生命的行为。
