释义	法律分析：保证人能起诉债务人。一般情况下保证人是在承担了保证责任后才会行使追偿权，向债务人提起诉讼，但是在债务履行期限届满，债务人有履行能力而债权人不主张权利时，此时虽然债权人也未向保证人主张权利，但保证人的保证责任并未免除，一旦债权人向保证人主张权利，保证人即可能承担保证责任。法律依据：《民法典》第七百条保证人承担保证责任后，除当事人另有约定外，有权在其承担保证责任的范围内向债务人追偿，享有债权人对债务人的权利，但是不得损害债权人的利益。
