释义	行为人构成倒卖文物罪，情节严重的，处五年以下有期徒刑或者拘役，并处罚金。情节严重，是指倒卖三级文物的，非法获利数额较大的，非法经营数额较大的，或者多次倒卖三级以下文物、倒卖三级以下文物多件的等情节。【法律依据】《刑法》第三百二十六条以牟利为目的，倒卖国家禁止经营的文物，情节严重的，处五年以下有期徒刑或者拘役，并处罚金；情节特别严重的，处五年以上十年以下有期徒刑，并处罚金。单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。
