释义	瑕疵担保责任，是担保责任中的一种，是指依法律规定，在交易活动中当事人一方移转财产或权利给另一方时，应担保该财产或权利无瑕疵，若移转的财产或权利有瑕疵，则应向对方当事人承担相当的责任。传统的瑕疵担保理论包括权利瑕疵和物之瑕疵，二者构成了完整的瑕疵担保责任制度。法律依据《中华人民共和国民法典》第六百一十条【出卖人根本违约的风险负担】因标的物不符合质量要求，致使不能实现合同目的的，买受人可以拒绝接受标的物或者解除合同。买受人拒绝接受标的物或者解除合同的，标的物毁损、灭失的风险由出卖人承担。
